Terms of Use
Last updated: 26 October 2026
These terms are an agreement between you and Down the Cove Group Ltd, a company registered in the United Kingdom (“we”, “us”). They apply when you use the ChaloChat app for iPhone and Apple Watch and its related services (together, “ChaloChat”). By creating an account or using ChaloChat you agree to these terms and to our Privacy Policy. If you do not agree, please do not use ChaloChat.
1. Who can use ChaloChat
- You must be at least 13 years old to create your own ChaloChat account.
- Children under 13 may only use ChaloChat through a Kids account that a parent or guardian creates and manages from their own account. The parent or guardian gives consent for the child, chooses who the child can talk to, and is responsible for the child’s use of ChaloChat.
- If you are under 18, you should have your parent’s or guardian’s permission to use ChaloChat.
- You must not use ChaloChat if you have been banned from it before, or if the law where you live does not allow you to.
2. Your account
- Give accurate information when you sign up, and keep your password and your phone secure. You are responsible for what happens on your account.
- Your messages are protected by keys stored on your device. If you lose your device or remove the app without a way to restore it, we may not be able to recover your messages.
- Tell us straight away at support@downthecove.com if you think someone else is using your account.
3. Acceptable use
ChaloChat is for keeping in touch with family and friends. You agree not to use it to:
- break the law, or help anyone else to break it;
- harass, bully, threaten, stalk, intimidate or abuse anyone, or encourage violence or self-harm;
- share content that sexually exploits or endangers children, or any sexual content involving anyone under 18 — we report this to the authorities;
- share hateful content that attacks people for who they are, or content that is violent, obscene or deliberately shocking;
- share other people’s private information, photos or location without their permission;
- send spam, scams, chain messages or unwanted advertising, or impersonate someone else;
- share content that infringes someone else’s copyright, trademark or other rights;
- send viruses or harmful code, or try to access accounts, devices or systems that are not yours;
- interfere with, overload, reverse-engineer or get around the security of ChaloChat, or use bots or automated tools to access it (except as the law allows);
- contact a child in a Kids account without the permission of their parent or guardian, or try to get around the controls a parent has set.
4. Your content
- You keep ownership of the messages, photos, videos, voice notes and other content you share (“your content”).
- You give us a limited, worldwide, non-exclusive, royalty-free licence to store, transmit and display your content only so far as we need to run ChaloChat for you — for example, to deliver your messages and show your profile to the people you share it with. For content you choose to share publicly (for example in a public Mehfil room or a public post), this includes showing it to the people who can see it there.
- You are responsible for your content and confirm you have the right to share it.
- Private messages and calls are encrypted on your device so that we cannot read them. Content you post publicly is not private, and anyone who can see it may copy or share it.
- People you message can save, forward or take screenshots of what you send them, including “view once” content.
5. Reporting, blocking and enforcement
- You can block people and report messages, people, rooms and posts from inside the app. When you report private messages, the content you choose to include is sent to us so we can review it.
- We may remove public content, limit features, or suspend or close accounts that break these terms or the law, or that put other people at risk. Where it is appropriate and safe, we will tell you why.
- We may share information with the police or other authorities where the law requires it or where someone is at risk of serious harm.
6. Stars and in-app purchases
- ChaloChat may offer “Stars”, a virtual item you can send as gifts in Mehfil rooms. Where Stars are sold, they are bought through Apple’s App Store and Apple’s terms and refund policies apply to the payment.
- Stars have no cash value, cannot be exchanged for money, and cannot be transferred outside ChaloChat except as the app allows. Unused Stars may be lost if your account is deleted.
- Nothing in these terms affects your legal rights as a consumer.
7. Optional features from other providers
Some optional features, such as GIF search, may use services run by other companies. When you use them, the text you search for is sent to that provider, and their terms may also apply. See our Privacy Policy for details.
8. Deleting your account
- You can delete your account at any time in the app: open the Settings tab, scroll to the bottom and tap Delete account. What happens to your data is explained in our Privacy Policy.
- We may close an account that breaks these terms, or that has not been used for a long time, after giving notice where we can.
9. Changes to ChaloChat and these terms
We are always improving ChaloChat, so features may be added, changed or removed. We may update these terms; if a change is important we will tell you in the app or on this page before it takes effect. If you keep using ChaloChat after a change takes effect, the new terms apply.
10. No warranty
ChaloChat is provided free of charge, “as is” and “as available”. We work hard to keep it running and secure, but we cannot promise it will always be available, free of errors, or that messages or calls will always be delivered. ChaloChat is not a replacement for emergency services: in an emergency, call your local emergency number (999 or 112 in the UK). Location sharing and SOS features depend on your phone, its signal and settings, and may not work every time.
11. Our liability
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law.
- Otherwise, we are not liable for losses that were not foreseeable, for business losses, or for losses caused by content other users share or by events outside our reasonable control.
- Because ChaloChat is free, to the extent the law allows our total liability to you is limited to £100.
12. Apple
These terms are between you and us, not Apple. Apple is not responsible for ChaloChat or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also follow the App Store’s usage rules.
13. Law and disputes
These terms are governed by the laws of England and Wales. Disputes will be dealt with by the courts of England and Wales, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts, and if you live elsewhere you keep any protection the law of your country gives you.
